No third party rights

You agree that, save as expressly provided for in this TOU, no third party shall have any rights under laws under Clause 16 of this TOU purporting to grant such enforcement rights, or any equivalent legislation in an applicable jurisdiction, and such laws are hereby excluded to the extent permissible.

Governing law and jurisdiction

You agree that this TOU and your access to and use of this web site are governed by the Republic of Indonesia and you agree for all disputed to be settled exclusively through BANI Arbitration Center (Badan Arbitrase Nasional Indonesia) to settle al disputes. If we provide a translation of the English language version of these TOU (including any referenced terms, conditions, policies, notices, guidelines, rules and instructions), the English language version shall govern and take precedence in the courts of any conflict.

Records

You acknowledge and agree that APL's records and any records of your access to, and the communications, transactions, instructions or operations made or performed, processed or effected through, this website by you or any person purporting to be you, acting on your behalf or purportedly acting on your behalf, with or without your consent, or any record of communications, transactions, instructions or operations relating to the operation of the website and any record of any communications, transactions, instructions or operations maintained by APL or by any relevant person authorised by APL relating to or connected with this website shall be binding on you for all purposes whatsoever and shall be conclusive evidence of such communications, transactions, instructions or operations. You agree that such records are admissible in evidence and that you shall not challenge or dispute the admissibility, reliability, accuracy or the authenticity of the contents of such records merely on the basis that such records were in electronic form or were produced by or are the output of a computer system, and hereby waive any of your rights (if any) to so object.

Force Majeure

APL shall not be liable for non-performance, error, interruption or delay in the website’s operation (or any part thereof) or for any inaccuracy, unreliability or unsuitability of the website’s contents if this is due, in whole or in part, directly or indirectly to an event or failure which is beyond its reasonable control which includes without limitation:- (i) flood, lightning, acts of God, fire, earthquakes, epidemic, pandemic, famine, plague and other natural disasters (ii) judgements, legislation, acts, orders, directives, policies, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any court, governmental, parliamentary and/or regulatory authority imposed or to be imposed after the fact (iii) power failure (iv) acts or defaults of any telecommunications network operator (v) circumstances where communications lines for APL’s computer systems (whether in Singapore or elsewhere) cannot be used for reasons attributable to third party telecommunications carriers and (vi) acts or omissions of any third party.
